Jurors presented tales of Jackson's promise, pain (AP)

LOS ANGELES ? Jurors in the involuntary manslaughter case against Michael Jackson's personal physician were presented with two portraits of the pop superstar during the first day of testimony ? one of an entertainer motivated to succeed at his first concerts in nearly a dozen years and the other of a man too damaged at times to perform.

The panel that will determine Dr. Conrad Murray's fate also got a sense of Jackson's international stardom after one of the promoters testified that after the singer's 50 comeback shows planned for London sold out, there was still demand for 50 more.

Jackson would never return to the stage, dying unexpectedly in June 2009 at age 50. Prosecutors drove the point home early in opening statements Tuesday, showing jurors a picture of a lifeless Jackson laying on a hospital gurney.

Hours later they played four minutes of Jackson's final rehearsals of two songs. His mother, Katherine, dabbed her eyes with a tissue as video of her son singing "Earth Song" filled the courtroom.

Jackson's persona was present throughout the trial's opening day, although prosecutors are now moving their case toward the events that led to his death and their immediate aftermath. Testimony from Paul Gongaware, an executive with concert promoter AEG Live will continue Wednesday morning, and he will be followed by one of Jackson's bodyguards and a personal assistant.

Days before Jackson's "Earth Song" performance during a rehearsal at Staples Center, the superstar's health prompted friend and collaborator Kenny Ortega to question whether the singer needed serious help. He had just spent hours cradling the singer, trying to warm him from deep shivers that kept him from rehearsing.

"He was like a lost boy," Ortega wrote in an email to promoters five days before Jackson's death. "There may still be a chance he can rise to the occasion if we get him the help he needs."

The email drew a rebuke from Murray, who Ortega said told him not to try to play amateur doctor or psychologist. Five days later, the singer was dead.

Prosecutors allege Murray caused Jackson's death by providing him with a lethal dose of the anesthetic propofol and other sedatives without the proper lifesaving equipment or skills. In opening statements, Deputy District Attorney David Walgren said Murray delayed summoning emergency crews and lied to doctors and medics when he failed to reveal that he had been giving Jackson the medications to try to help the entertainer sleep.

One of the day's most stunning moments came when Walgren played a recording of a conversation between Jackson and Murray in which the singer detailed what he wanted out of the shows. Jackson's voice, though recognizable, was slow and slurred.

"We have to be phenomenal," Jackson is heard saying in the recording, which investigators gleaned from Murray's phone after the singer's death. "When people leave this show, when people leave my show, I want them to say, `I've never seen nothing like this in my life. Go. Go. I've never seen nothing like this. Go. It's amazing. He's the greatest entertainer in the world.'"

Murray's lead defense attorney Ed Chernoff also noted Jackson's desire for success, but that the singer's ambition ultimately prompted him to give himself a fatal dose of medication.

He said Murray had been trying to wean Jackson off propofol, but that the entertainer kept requesting it on the day he died to help him sleep.

"Michael Jackson started begging," Chernoff said. "When Michael Jackson told Dr. Murray, `I have to sleep. They will cancel my performance,' he meant it."

He told jurors that Jackson swallowed enough of the sedative lorazepam to put six people to sleep before ingesting propofol. The combination, which Chernoff called a "perfect storm" of medications, killed Jackson so quickly that he didn't even have chance to close his eyes.

Prosecutors reject Murray's version and told jurors the Houston-based cardiologist also had a tremendous stake in Jackson appearing in the concerts.

The doctor had initially asked to be paid $5 million a year for working with Jackson, but Gongaware said he immediately rejected the proposal. Instead Murray accepted an offer to become Jackson's doctor for $150,000 a month ? a sum he was never paid because his contract hadn't been signed before Jackson's death.

Murray still has plenty to lose ? if convicted he faces up to four years in prison and will have to relinquish his medical license.

I have a large pipe running across the ceiling of my garage. I believe it to be a drain pipe. About 6 months ago I noticed a very small leak. It wasn't constant, but instead an unsteady dripping. I noticed the pipe was discolored and showing signs of rust. A plumper suggest Plumbing Epoxy as a fix versus replacing the whole pipe. I epoxied the two areas that had small drippings.

Yesterday I saw that the larger spot was shiny. A light gloss of water had seeped through the epoxy, not out of the sides, but straight in the middle of the epoxy.

I've attached pictures. What is your suggest? Should I sand off the old epoxy and place new on? Should I get a repair pipe clamp for the area? Cut the area that's rusted/weak and attach a no-hub coupling PVC pipe to the old pipe? It obviously needs replacing. I'd like the strongest yet cheapest DIY option. Thank you so much in advance!

Obama says he can't fix immigration on his own (AP)

WASHINGTON ? Facing weakening support among Hispanics, President Barack Obama expressed deep frustration Wednesday over what he called an inaccurate and damaging perception that he can fix the nation's flawed immigration system on his own.

"This notion that somehow I can just change the laws unilaterally is just not true," Obama said during a White House roundtable targeting Hispanic voters, a key constituency for the president's re-election campaign.

The president said comprehensive immigration reform continues to be a "top priority" for his administration. But he blamed Republicans in Congress for failing to join Democrats in supporting legislation that would address the flow of foreigners into the U.S. and deal with illegal immigrants already in the U.S.

"Only a few years ago, as I said, you had some Republicans who were willing to recognize that we needed to fix our immigration system," Obama said, noting that his predecessor, George W. Bush, was among them. "Right now you do not have that kind of leadership coming from the Republican Party."

A strong majority of Hispanics supported Obama's election in 2008. But his support among Hispanics has declined, as it has in the broader population. A recent Gallup survey found 48 percent of Hispanic voters approving of Obama's job performance, compared with 60 percent in January.

While Obama has made little progress on comprehensive immigration legislation, he has pushed Congress to pass the Dream Act, which would provide a route to legal status for college students and service members brought to the country as children. The bill passed the House last year when it was controlled by Democrats but was blocked by Senate Republicans.

"I think there's been a great disservice done to the cause of getting a Dream Act passed and getting comprehensive immigration passed by perpetrating the notion that somehow by myself I can go and do these things," Obama said. "We have to pass bills through the legislature and then I can sign it."

Democrats view Hispanic voters as a voting bloc in 2012 that could help determine the outcome in swing states such as Florida, Colorado and Nevada. The Democratic National Committee has aired Spanish-language ads in those states in the past week to tout the benefits of Obama's jobs bill for small business and workers in the construction industry, which the DNC said employs 2.77 million Hispanics.

Hispanics accounted for more than half of the U.S. population increase over the last decade, exceeding estimates in most states and totaling 50 million.

The burgeoning Hispanic population, Obama said, means it will only be a matter of time before the country sees a strong Latino candidate for president or vice president.

"I am absolutely certain that within my lifetime we will have a Latino candidate for president who is very competitive and may win," Obama said.

The president spent more than 30 minutes taking questions submitted online, covering topics from U.S. policy toward Cuba to the president's $447 billion jobs bill. Obama said the jobs legislation would have a particularly positive impact on the Hispanic community, which has an unemployment rate of 11.3 percent, compared with the national unemployment rate of 9.1 percent.

Obama also said he believed federal courts would rule "fairly soon" on the Defense of Marriage Act, or DOMA, the law that defines marriage as between one man and one woman. While the White House backs repealing DOMA through Congress, Obama said Wednesday that he does not believe there are enough votes on Capitol Hill to overturn the law.

The president was also pressed on the status of Puerto Rico, where a statehood referendum is planned for next year. Obama said he believes the island will remain a U.S. commonwealth unless there is a "solid indication" of support for statehood.

"If it split down the middle or 51-49, I think Congress' inclination is going to be not to change but to maintain status quo until there is greater indication there is support for change," he said.

It's unclear whether any Republican presidential candidate can sway Hispanic voters. Several top GOP contenders, including former Massachusetts Gov. Mitt Romney, have taken a hard line on immigration, calling for a fence and more troops along the border with Mexico to stop the flow of illegal immigrants.

Texas Gov. Rick Perry has been the outlier on immigration in the Republican field, and he is hoping his moderate record will appeal to Hispanics. But his rivals believe Perry's stance on immigration could be a weakness with his party's more conservative wing.

Perry insists that a physical border fence is an impractical way to control the flow of immigrants into the U.S. He also supported a 2001 Texas law that allows the children of undocumented immigrants to receive in-state tuition at Texas universities if they meet certain requirements.

(AP) ? American endurance swimmer Diana Nyad began her second attempt in as many months to traverse the 103 miles of sea between Cuba and Florida, waving goodbye to well-wishers before jumping feet first into the still water at a Havana marina, then stroking toward the horizon.

The 62-year-old Los Angeles woman hoped to break her own world record for open-water swimming without a shark cage that she set in 1979 when she stroked from the Bahamas to Florida.

Her last attempt at the Cuba-to-Florida crossing failed Aug. 9 due to a crippling asthma attack that forced her gasping from the water after 29 hours.

Nyad insisted that this time around she was ready to brave the choppy seas, schools of jellyfish and limits of human exhaustion to accomplish her lifelong dream.

As darkness fell, about an hour and a half into the swim, Nyad's team sent a Twitter message that she was "going strong."

Just before she set off from Hemingway Marina on Friday evening, assistants smeared grease on her shoulders to prevent chafing during the planned 60-hour journey. She pumped her fists in the air as her support team blew horns and cheered from waiting boats.

"I feel good. I feel very good," Nyad said. "But as you know, it really doesn't matter how I feel right now."

She acknowledged being a little more subdued than the last time she departed from this same marina.

"Not that I was ever cocky, but having been through this now and been so deeply, emotionally disappointed, I don't want to take anything for granted," Nyad said.

"It's not that I don't want to enjoy every moment and savor it, but it doesn't do any good to act like, 'Hey I've got this in the bag, this is going to be easy.'"

Before jumping in, Nyad weighed herself, tipping the scales at 146 pounds. She said she expected to lose about 15 pounds over the course of the journey. Her schedule called for to reach Florida early Monday morning.

She hoped to take advantage of what she called a "magical window" of calm seas and favorable weather forecast to last through the weekend.

Last month after her previous attempt failed, Nyad had vowed there would be no repeat, but she joked earlier Friday that nobody should have believed her.

"Don't listen to athletes when they say it's over," she said.

Nyad likened herself to former boxer Roberto Duran, who retired in 1998 at age 47 only to re-enter the ring a year later.

Nyad denied her problems in the last attempt had anything to do with her age, saying she could have fought through the choppy waves and "excruciating" shoulder pain. But she hadn't anticipated the 11-hour asthma attack that she blamed on a reaction to a medicine she had never used before. She said the asthma had her flailing through the water "like a dying, floundering fish."

Even with those problems, she made it about 50 miles (80 kilometers) into the 103-mile (166-kilometer) haul.

In the ensuing weeks she concluded that the aborted attempt was not so much a failure as a dress rehearsal, an unplanned but necessary part of a training regimen that included a bunch of shorter swims.

"The asthma took me down, but ironically enough, that 29-hour swim was like a very, very expensive training swim," said Nyad, who earlier this year estimated it took a half-million dollars to get her to the first attempt.

"I'm in better shape than before. I'm more prepared than ever," she added.

Without a cage for protection, Nyad is relying on special equipment that surrounds her with an electric current imperceptible to humans but strong enough to keep most sharks at bay. Kayakers also are paddling alongside to gently prod away any that make it through.

For the length of the crossing, Nyad will not be allowed to touch the boat if the record is to count. Nor can her team physically aid her other than to pass her food, medicine, a new swimsuit and so on.

She will try to sustain her energy by eating the likes of peanut butter sandwiches and pasta, and said she sings Beatles, Bob Dylan and Janis Joplin songs in her head to keep her mind occupied, especially during nighttime.

"I never ever ? it's the cardinal rule ? I never look up because it's very depressing to see the horizon with no lights, no nothing. And I never ask my trainer here in the boat what time it is or, 'Are we almost there yet?'" Nyad said. "They're going to tell me when we're about 10 hours away."

Nyad first tried to cross the Florida Straits as a 28-year-old back in 1978, when she swam inside a steel shark cage for about 42 hours before ending the attempt.

Now 62, after celebrating her birthday Aug. 22, she has said she hopes to inspire people to lead active lives into their golden years. She also has called the swim symbolic for increasing understanding between the United States and Cuba, two nations torn by five decades of animosity and mistrust.

Marina commodore Jose Miguel Diaz Escrich, whom Nyad described as a cherished friend and who helped with logistics in Cuba, presented her with an honorary membership in the nautical club earlier Friday and called the swim a "bridge of friendship" between the countries.

"He who tries has already succeeded," Escrich said in encouragement, quoting Cuban poet and independence hero Jose Marti.

Nyad's team had hoped to attempt the swim in 2010, but was unable to make arrangements in time. This year Cuban officials were very supportive in arranging logistics and news media coverage.

"We're ready for everything that could possibly come our way this time," Nyad said, "and I just can't imagine any ending other than the ending that I want, which is to get all the way across."

S&P downgrade casts shadow over Italian government (AP)

MILAN ? Standard & Poor's cast more doubt over the stability of both Italy's government and its finances on Tuesday, when it downgraded its credit rating and cited political weakness as a key risk for the eurozone's third-largest economy.

The Italian government was quick to criticize the downgrade as politically motivated. It was not the first government to attack a rating agency for its decisions ? authorities in the U.S. and across the EU have done so, angered by what they consider a counterproductive move at a time when they were trying to contain worries about their sovereign debt.

But the S&P downgrade hit Italy at a particularly vulnerable moment. Investors now are less confident about its financial prospects than Spain's ? for decades viewed as the weaker economy ? and widely consider it to be the next most likely victim of the debt crisis.

"In our view, Italy's economic growth prospects are weakening and we expect that Italy's fragile governing coalition and policy differences within parliament will continue to limit the government's ability to respond decisively to domestic and external macroeconomic challenges," S&P said in its report.

The sensitivity of the issue was apparent in the rapid criticism the agency received for its surprise downgrade of Italian sovereign bonds to A from A+.

The Italian government accused the agency of being more influenced by newspaper reports critical of the government than the reality of a euro54 billion ($70 billion) austerity measures approved last week that aim to balance the budget by 2013.

"The evaluation by the ratings agency seems to be dictated more by behind-the-scenes reports in daily newspapers than reality and appear to be tainted by political considerations," the government said in a statement.

S&P responded with a terse five-line statement saying sovereign debt ratings are "apolitical."

Markets, which were buoyed by hopes that Greece will not be allowed to default, took the events in stride and stocks in Milan closed higher. But the downgrade is likely to reinforce fears that Italy is getting sucked into Europe's debt crisis.

Italy's debt burden is the second highest in the eurozone after Greece. It has carried heavy debts successfully for years because bond investors have always been willing to loan more money as bonds came due.

But bond markets began to look more skeptically at Italy after Greece, Ireland and Portugal needed bailouts and the government has had to pay more to borrow as a result.

S&P said Berlusconi's "fragile" coalition and the political deadlocks that have blocked reforms were a risk.

The agency's managing director, Moritz Kraemer, told investors on a conference call that the rating could be cut again in 12 to 18 months if Italy's debt rises above its current level of around 120 percent of GDP ? one of the highest among the countries rated by S&P's.

The downgrade was precipitated on significantly lower growth forecasts ? down to an average of 0.7 percent annually between now and 2014 from a projection of 1.3 percent made in May. S&P also expects lower exports, domestic consumption and investment during the period.

Unicredit economists said the S&P's moribund growth forecasts for Italy were largely in line with their own, but disagreed with the agency's assumption that the austerity package will be ineffectual.

"While we have repeatedly argued that much bolder action is needed on the growth if Italy wants to win back market (and rating agencies') confidence, we do not share the view that the recently approved measures to simplify the public administration, increase labour market flexibility and push forward privatizations and service sector liberalization will have zero impact on medium-term GDP prospects," analysts Chiara Corsa and Loredana Federico said in a note.

An important element of the S&P decision was the lack of determined political response to the growing debt crisis. S&P cited the fact that the government, under market pressure, twice expanded the austerity measures and that there was an apparent lack of bipartisan will to fix Italy's economic woes.

While Spain managed to create bipartisan support for a constitutional amendment setting a debt ceiling, there has been no similar commitment in Italy, Kraemer said, noting dissent even within Berlusconi's governing coalition.

The markets have also noted the differences. In recent weeks, Italian borrowing rates have edged higher than Spain's. The benchmark bond yield was at 5.67 percent on Tuesday, compared with 5.35 percent in Spain.

Kraemer also said the Italian election cycle does not guarantee that the promised austerity measures will be kept. Berlusconi's mandate ends in 2013, but his main coalition partner Umberto Bossi has recently indicated he is not sure the majority can hold that long.

In addition, many of the austerity measures count on new revenue, and not the kind of structural reform that will promote growth, Kraemer said.

"We consider that the political situation lends itself more easily to a situation of gridlock and delayed policy response than in other countries where the funding costs have gone up," he said.

Despite the downbeat assessment, he said it was unlikely that a country with an A rating would be unable to fund its debt needs ? as has been the case with Greece. Italy currently carries a public debt of euro1.9 trillion ($2.6 trillion), a portion of which must be refunded each year through the sale of government bonds.

As borrowing costs rise, so does the cost of carrying that debt. If costs go too high, the risks is a government would default. An Italian default would be a devastating event with wide-ranging ramifications that policymakers want to avoid.

Turkey-North Cyprus gas deal set to raise regional tensions (Reuters)

ANKARA (Reuters) ? Turkey signed a deal with the breakaway Turkish Cypriot state on Wednesday that will pave the way for offshore gas exploration, in a move set to escalate regional tensions over Mediterranean energy reserves.

On Tuesday, the Greek Cypriot government, which has been at loggerheads with Turkey since its military invasion of north Cyprus in 1974, said drilling had begun in a southeastern offshore block, adjoining a gas field in Israeli waters reputed to be the world's largest find of the past decade.

Turkish Prime Minister Tayyip Erdogan described the offshore drilling by Cyprus and Turkey's estranged ally Israel as "madness" before signing the deal with the Turkish Cypriots to clear the path for Turkish exploration off northern Cyprus.

"We had previously brought to the international community's attention in a clear manner ... that if the Greek Cypriots started drilling, we would take a number of concrete steps together with the Turkish Republic of Northern Cyprus," Erdogan was quoted as saying by state news agency Anatolian.

"To reflect this commitment, Turkey and the Turkish Republic of Northern Cyprus today in New York signed a continental shelf agreement."

"ILLEGAL"

Turkey is the only country to recognize the Turkish Cypriot state, while the Greek Cypriot government is internationally recognized and represents the island in the European Union.

Both Cyprus and Greece denounced the agreement as illegal.

"Turkey has committed yet another illegal act by signing an agreement with an illegal entity, such is the pseudo-state, which has been condemned by U.N. resolutions," government spokesman Stefanos Stefanou said in a statement.

"Turkey is attempting to prevent the Republic of Cyprus from

exercising a self-evident right, one which is acknowledged by the international community, which asks that Turkey respect international legality. Unfortunately Turkey persists in acting illegally."

Turkey's neighbor and historic rival, Greece, reiterated its criticism of the pact.

"This move from Turkey is against international law and U.N. Security Council decisions. The so-called 'deal' is invalid and groundless," the foreign ministry said in a statement.

Cyprus has been split since the 1974 invasion in the aftermath of a brief Greek-inspired coup in Nicosia, and Turkey maintains a military presence in the Turkish Cypriot state.

Turkey argues that the Greek Cypriot government should not have started gas explorations before reaching a settlement in reunification talks with the Turkish Cypriots, and that the mineral wealth belonged to both communities.

"The Greek Cypriot administration and Israel are engaging in oil exploration madness in the Mediterranean," Anatolian quoted Erdogan as telling Turkish reporters early on Wednesday.

"Actually, the Greek Cypriot administration's drilling activity is nothing but sabotage of the negotiation process between Turkish Cypriots and Greek Cypriots," he added.

Peace talks between the two sides were launched in 2008 but progress has been slow. The United Nations is tentatively eyeing a settlement before July 2012 when Cyprus is due to assume the European Union's rotating presidency.

The row over hydrocarbon reserves erupted as relations between Turkey and Israel broke down over Israel's refusal to apologize for killing Turkish activists aboard a ship carrying aid to Palestinians in Gaza last year.

Under Erdogan, Turkey has become increasingly assertive in the region and it disputes the offshore territorial agreement struck last year by Cyprus and Israel.

Texas-based Noble Energy which is carrying out the drilling operations for Cyprus, has been conducting offshore drills in the eastern Mediterranean for Israel since 1998.

Turkey has said it would use its navy and air force to escort any gas exploration vessels it may dispatch in the Mediterranean if Cyprus pressed ahead with drilling.

Erdogan again referred to Turkey's military muscle on Wednesday: "Our assault boats and frigates are already in the region," Anatolian quoted him as saying.

Last week the Turkish leader said warships could be sent to the eastern Mediterranean any time and Israel could not do whatever it wants there.

The European Commission has called for Cyprus and Turkey to show restraint in the gas row and work toward a settlement on the island.

Cyprus has said it will block negotiations Turkey began in 2005 to join the European Union if Ankara continues to oppose its gas exploration. Turkey has said it will freeze relations with the EU Presidency if Cyprus is given the role next July before a settlement over the island is reached.

PhD Comics Hits the Big Screen

The creator of the popular online comic strip "Piled Higher and Deeper" has turned it into a feature film. The PhD Movie, which opened this week at a handful of US universities, will be screened at campuses worldwide in the coming months. Nature caught up with former robotics researcher turned cartoonist Jorge Cham to find out about his film.

Why turn the comic strip into a movie?
The spark was a spoof of a Lady Gaga video put together by some scientists in Texas. It looked like so much fun. But a lot of things were pointing in that direction?for a long time people had been asking me when I would do it, and independent productions are now easier to make and distribute. I just thought it would be a great opportunity.

What is the film about?
It is a light comedy with a little bit of romance. The plot focuses mainly on two PhD students: a newbie struggling to prove himself to his professor, and another who is trying to finish her PhD and is struggling with what will happen next. As in the comic strip, you never quite find out what they are studying and you never learn the new student's name?which is meant to be a kind of metaphor for being the nameless graduate student.

How did your background help in writing it?
I got my PhD in robotics from Stanford University (in Palo Alto, California), and then I worked in a neuroscience lab at Caltech (California Institute of Technology in Pasadena). I think it helps being someone who has lived through it. I try to be as truthful as possible with the comics and the movie.

You wrote the script, but it was produced, directed and acted by actual Caltech PhD students, professors and scientists. Why not use professionals?

Part of the theme of the movie is that scientists and academics are multidimensional. They aren't the awkward, geeky, nerdy caricatures that we see in popular-culture stereotypes. They have different passions and talents. I thought it would be cool artistically if the production of the movie also carried that theme. They could also relate to the material and knew how to keep it truthful. Often, people who make movies and television shows about scientists have no sense of what the reality of their lives is like.

How did you find the actors and crew?
Because I worked at Caltech for a couple of years, I knew they had a theatre department, so I approached them to see if they wanted to collaborate and they said yes. A call went out and people who were interested in all kinds of different aspects of production showed up. It was all filmed on the Caltech campus. Hardly anybody involved in this movie had ever made one before, including me.

How are you distributing the film?
The first roll-out is to hold screenings at universities. They started this week and we have lots scheduled internationally (see the list here). But it is not too late?campus groups can still contact us to arrange one. There is a screening fee for the movie that depends on institution size.

Will people find the film as funny as they find the comics?
It is a difficult leap, but I hope they will. A lot of the jokes come from the comics, but there is a little bit more heart and humanity in the movie because it has live actors.

Does the film have a message for PhD students?
Graduate school and academic institutions in general can be very isolating. People feel alone and then get depressed or drop out. The message of the movie and the comic strip is you are not alone.
